A BILL to amend article five-f, chapter twenty of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section twelve, relating to county assessment for Class A facilities; restrictions and purposes.

Be it enacted by the Legislature of West Virginia:

That article five-f, chapter twenty of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section twelve, to read as follows:
ARTICLE 5F. SOLID WASTE MANAGEMENT ACT.

§ 20-5F-12. County assessment for Class A facilities; amount; restrictions; purposes.

Notwithstanding any provisions of this code to the contrary, the county commission of any county containing a Class A facility may, in addition to any fee otherwise imposed by law, impose a fee not to exceed two dollars per ton of solid waste received from within or without the waste shed in which the facility is located for solid waste disposal in said facility: Provided, That any moneys received by a county commission pursuant to this section shall be expended exclusively for:

(a) Capital improvements to the infrastructure within the county, including, but not limited to, water supply treatment, waste treatment, sewage systems and road maintenance, as well as the expenses associated therewith;
(b) Public works including, but not limited to, airports, roads, bridges, highways, public buildings and structures and expenses related thereto including equipment; and
(c) For the protection of the health, welfare and safety of the county citizens, including, but not limited to, police and fire protection, emergency services and expenses related thereto.



NOTE: The purpose of this bill is to authorize county commissions of any county having a Class A solid waste facility to impose a fee not to exceed two dollars per ton for solid waste received from within or without the waste shed in which the facility is located for solid waste disposal in such facility.
